r <br />o o <br />N <br />a w <br />.vrv^'^-i 4..CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2953 <br />WHBRBASr it is the intent of this resolution to <br />continue and restate certain conditions of the permit granted by <br />No. 2193 and to add the amendments now reguiredf and <br />to consolidate all conditions applicable to the subject property <br />in this Resolution; and <br />MHBRBASr the contents of the Planning Commission review <br />and recommendation File 1497 are hereby entered into and made <br />part of the public hearing record and the record of decision for <br />this application. <br />CONCLOSION <br />THBRBFORB BB IT RBSOLVBD^ based on one or more of <br />the above Findings that Resolution No. 2193 (Resolution No. 2193 <br />filed as Document No. 1870061) is hereby rescinded and replaced <br />by this Resolution which continues and amends a conditional use <br />permit to the subject property for the purposes of permitting a <br />boat sales/nautical shop within the LR**1A, Lakeshore Residential <br />District at the location described above based on the <br />following conditions: <br />1. That the property described herein may be used for a <br />boat sales/nautical shop^ so long as applicant commences to <br />operate a boat sales/nautical shop by April 22, 1992. <br />2. That the boat sales/nautical shop be open and operating <br />during the seasonal period businesses of a similar nature <br />are open, including the period between April 15 through <br />October 15 of each year. <br />3. That "open" and "operating" shall mean at a minimum the <br />business is open to the public on a regular basis at least <br />four days per week, excluding legally recognized holidays, <br />during the hours between 10:00 a.m. and 6:00 p.m. <br />4. That the boat sales/nautical shop shall not be open <br />after 8:00 p.m. on weekday nights, due to its proximity to <br />residential properties. <br />5. That applicant shall maintain inventory sufficient to <br />sustain the business as a viable economic enterprise. <br />Applicant shall employ staff knowledgeable and experienced <br />in the business of boat sales/nautical shop. <br />Page 2 of 5 <br />7)
