Floyd, 960 West Femdale Road <br />Our File No. 1652.9701 <br />Dear Mr. Mitchell: <br />Thank you for your letter dated September 11, 1997. <br />First, let me reassure you that my clients and I are not moving forward imder the false <br />assumption that an assignment of a real estate tax identification number is a definitive way of <br />indicating ownership of land. Also, we realize that no separate real estate tax identification <br />number has been assigned to the 20 Ft. Parcel (the triangular property at the easternmost tip <br />of Lot 12 of North Shore Cottage Acres). There has been no explanation from anyone why <br />this was not done at the time of the sale, when the deed was recorded or at any time since. <br />Second, my clients’ position regarding the 20 Ft. Parcel remains the same as it was last <br />spring when we first discussed this matter with you and your clients. You incorrectly stated <br />in your letter that the best case scenario for my clients is to ultimately retain ownership of only <br />a one-half interest in the 20 Ft. Parcel. You are well aware of the fact that my clients intend <br />and expect to receive an order from the Court or the Examiner of Titles of Hennepiri County <br />stating that they are the exclusive owners of the 20 Ft. Parcel by way of adverse possession. <br />As I am sure you are aware, my clients have maintained exclusive possession and use of the <br />20 Ft. Parcel for in excess of the statutory time period to claim adverse possession. Without <br />restating issues and facts that you and your clients are already aware of, suffice it to say that <br />my clients have always maintained their exclusive ownership, possession and interest in the 20 <br />Ft. Parcel, against everyone, including the owners of 980 West Femdale Road. Please be <br />advised, my clients have never surrendered or sacrificed their exclusive ownership, possession <br />or interest in the 20 Ft. Parcel at any time since they have resided at 960 West Femdale Road. <br />Moreover, previous owmers of 960 West Femdale Road also 'sserted their exclusive ownership <br />rights over the 20 Ft.
