Box 66 <br />Crystal Bay, MN 55323 <br />Re: Charles and Joan Floyd <br />Our File No. 1652.9701 <br />R'CIHZ)I • I I ■" ~ /~r~\ <br />SEP 2 5 .*’,997 <br />Dear Mr. Gaffron: <br />After attending the Orono City Planning Commission meeting on Monday, September <br />15, ’.997, it became evident that the City is expecting certain things to happen that my clients, <br />Charles and Joan Floyd, do not necessarily anticipate nor want to happen. Specifically, I am <br />referring to the future use, ownership and existence of the 20 Ft. Parcel .ind the "Suip Land" <br />to the south of West Ferndale Road between the 20 Ft. Parcel and 905 West Femdale Road. <br />Your comments at the meeting seem to indicate that you believe, as does Conley <br />Brooks, that the fate of the 20 Ft. Parcel will eventually result in the Floyds and the Brooks ’ <br />sharing it, with Mr. Brooks also owning the Strip Land exclusively. <br />Please be advised, one of the issues currently pending at the Office of the Examiner of <br />Titles of Hennepin County is whether my clients own the 20 Ft. Parcel exclusively. With <br />re.spect to the Strip Land, a final determination has not yet been made regarding the owTiership <br />and use of the Strip Land. Therefore, your comments regarding how you expect things to turn <br />out were purely speculative and coincidentally against my clients’ interest. <br />As for your comments ’ impact on the Planning Commission ’s decision to grant Mr. <br />Brooks ’ Subdivision Application for Lot 13 of North Shore Cottage Acres, I believe that your <br />comments were influential in persuading the Commission by showing that there is, at least in <br />your mind, a good possibility that Mr. Brooks will eventually own a continuous stretch of land <br />extending from his homestead property. Nonetheless, I expect the City Council to table the <br />matter as with Mr. Brooks ’ other Subdivision Application until the issues regarding the 20 Ft. <br />Parcel euid the Strip Land have been resolved. <br />With respect to the resolution of the 20 Ft. Parcel and the Strip Land, the last time I <br />spoke with the Examiner of Titles was on September 2, 1997, w hen the Examiner postponed <br />Americana Bank Building , 5050 France Avenue South, Suite 240, Edina , MN 55410 <br />* Certified by the Real Property Law Section of the Minnesota State Bar Association as a Real Property Law Specialist
