r <br />A RESOLUTION GRANTING A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 15 (C), <br />SECTION 10.55, SUBDIVISION 8, AND <br />SECTION 10.56, SUBDIVISION 16(C)(5), AND <br />GRANTING APPROVAL FOR A FENCE WITHIN <br />WEST FERNDALE ROAD PER <br />MUNICIPAL CODE SECTION 6.07, SUBDIVISION 1 <br />FILE #2295 <br />WHEREAS, Conley Brooks, Jr. (hereinafter "the applicant") is owner of the <br />property located at 980 West Femdale Road within the City of Orono (hereinafter "City") and <br />legally described as follows; <br />Exhibit A attached (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for variances to Municipal <br />Zoning Code Sections 10.03, Subdivision 15 (C), 10.55, Subdivision 8, and 10.56, Subdivision <br />16 (C, 5) to permit the construction of a 6' high fence within or adjacent to a front or street <br />yard where only a 3 1/2* high fence is normally allowed, and to construct such fence within <br />75 of the lakeshore where no fences are normally allowed; and requests permission for <br />construction of such fence within the right-of-way of West Femdale Road per Municipal Code <br />Section 6.07, Subdivision 1. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #2295. <br />The property is located in the LR-IA, Single Family Lakeshore Residential <br />Zoning District. <br />Page 1 of 6
