r <br />k’. <br />D.No use shall be made of the Easement Area except uses, if any, which will <br />not change or alter the natural condition of the Easement Area, and no use <br />which would tend to change the drainage, flood control, water <br />conservation, erosion control, soil conservation, fish and wildlife habitat <br />charaaeristics shall be made of the Easement Area or the water situated <br />thereon. <br />Owner releases, acquits and forever discharges forever the City and any and all of <br />its officers and employees of and from any and all claims, demands or causes of action <br />of any kind or nature \vdiatsoever which may rise or accrue by virtue of any flowage or <br />trespass with water. <br />Owner does not intend that the public should have any interest in the Easement <br />Area by virtue of this Indenture or odierwise, except as hereinabove set forth. <br />O^^er covenants that the Owner owns and is in possession of the Easement Area, <br />and has the lawful right and authority to convey and grant the Easement herein granted. <br />State Deed Tax Due Hereon: Exempt <br />IN TESTIMONY WHEREOF, Owner has signed this Indenttire as of the date <br />first set forth above. <br />TRUSTEES: <br />James G.
