CHAPTER No. 235 H.F. No. 244 <br />1 (e) If the local unit of government with jurisdiction over <br />2 the system has adopted an ordinance containing local standards <br />3 pursuant to subdivision 7, the existing system must comply with <br />4 the ordinance. If the system does not comply with the <br />5 ordinance> it must be upgraded» replaced^ or its use <br />6 discontinued according to the ordinance. <br />7 (f) If a seepage pitf drvwell» or leaching pit exists and <br />8 the local unit of government with jurisdiction over the system <br />9 has not adopted local standards to the contrary, the system is <br />10 failing and must be upgraded, replaced, or its use discontinued <br />11 within the time required by subdivision 3 or local ordinance. <br />12 (q) If the system fails to provide sufficient groundwater <br />13 protection, then the local unit of government or its agent shall <br />14 order that the system be upgraded, replaced, or its use <br />15 disconjtinued within the time required by rule or the local <br />16 ordinance. <br />17 (h) The authority to find a threat to public health under <br />18 section 145A.04, subdivision 8, is in addition to the authority <br />19 to make a finding under paragraphs (b) to (d). <br />20 iei Subd. 5b. [COMPLIANCE NOTICE. ] ^aj. If a system <br />21 inspected under this subdivision 5 is not-in-eonpiianee-wifeh-fche <br />22 appiieabie-requiremenfcs required to be upgraded, replaced, or <br />23 its use discontinued under subdivision 5a, the inspector or site <br />24 evaluator or designer must issue a notice of noncompliance to <br />25 the property owner and must provide a copy of the notice to <br />26 the ioeai unit of government to-whieh-appiieafcion-for-fehe <br />27 boiiding-permit-or-varianee-was-raade with jurisdiction. The <br />28 notice of noncompliance must specify why the system must be <br />29 upgraded, replaced, or its use discontinued.
