r Tn <br />ORDINANCE NUMBER’118 SECOND SERIES <br />AN ORDINANCE TO AMEND MUNICIPAL CODE SECTION 12.30 BY REVISING THE <br />REQUIRED TIMEFRAME FOR REPAIR OR REPLACEMENT OP NON-CONFORMING <br />SEPTIC SYSTEMS <br />The City Council of Orono ordains as follows: <br />Section 1. The City of Orono Municipal Code, Chapter 12, is <br />hereby amended by deleting the existing language of Section 12.30, <br />Subd^^^(B^(^^^an^replacin^i^withth^^ollow^ <br />I 4. Owners of non-conforming systems shall be issued <br />I orders requiring maintenance, repair, alteration or <br />1 replacement. Systems found to be non-conforming shall be <br />I brought up to conforming status per Subdivision 5 (O’ as <br />I follows: <br />a) Systems found to be non-conforming due solely to <br />lack of 3 feet of unsaturated soil or sand between <br />the distribution device and the limiting soil <br />characteristics, shall be repaired, altered or <br />replaced within a reasonable period of time not to <br />extend past December 31 of the second year <br />following the year in which repair orders are <br />issued, the intent being that at least two full <br />construction seasons (May thru November) shall be <br />allowed for completion of repairs.- <br />b) Systems found to be non-conforming because they are <br />either "failing” or "prohibited" as defined in <br />Subd. 2 of this section, shall be repaired, altered <br />or replaced within 90 days if feasible but in no <br />case later than 1 calendar•year after the date of <br />the repair order. <br />c) Sewage tanks rec[uiring pumping in order to <br />eliminate a discharge shall be pumped within 48 <br />hours and as often as necessary thereafter to limit <br />or eliminate effluent discharge until system <br />repairs are completed. <br />SECTION 2. Adoption and Publication.
