Ordinance Amendment <br />September 18,1997 <br />Page 2 <br />i i’ <br />members of the public were still present at 1:15 a.m, for the discussion. Planning Commission voted <br />4-2 to recommend approval of the ordinance changes as drafted. One of the minority voters <br />indicated 10 years may be too long to Mow repair of non-compliant systems to be delayed when <br />they are near the lakes. <br />Staff Recommendation <br />It is staffs understanding that the concerns reflected in the Council's desire to extend the timeframe <br />for septic system replacement are: <br />1. Uncertainty regarding potential sewer provision in the rural area. <br />2. Uncertainty regarding potential changes to on-site septic system regulations at the <br />State level. <br />From staffs perspective a 5-year time frame should be sufficient to address these uncertainties. It <br />is also more consistent with the DNR's intent that non-compliant Shoreland septic systems be <br />upgraded as soon as possible. <br />The City should commit to studying whether (and where) sewer expansion in the rural area will <br />occur; complete such a study in the most timely manner possible; and then reconsider whether <br />extended upgrade timeframes are appropriate. <br />Council Action Requested <br />The attached Ordinance reflects the majority recommendation of the Planning Commission and may <br />be adopted if Council so desires. Because the Shoreland Ordinance is part of the zoning code, a 4/5 <br />vote is required.
