A RFSOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUED. 12 <br />FILE NO. #2297 <br />WHEREAS, Daryl E. Hansen, architect on behalf of Mrs. Robert Keith <br />(hereinafter "the applicant") representing the owner of the property located at 1045 Edgewood <br />Hill Road within the City of Orono (hereinafter "the City") and legally described as follows: <br />Tract D, Regisicied Land Survey No. 1098 (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.03, Subd. 12 to permit an addition to the existing residence to be <br />located 5.17* from an existing swimming pool where a 10’ separation is required and a 5.17' <br />separation exists. A swimming pool is considered an accessory structure. <br />NOW, THEREFORE, BE IT RESOLVED by the City Coimcil of Orono, <br />Minnesota: <br />FINDINGS <br />3. <br />This application was reviewed as Zoning File 2297. <br />The property is located in the RR-IB Single Family Rural Residential Zoning <br />District requiring 2 acres in area. The property consists of 82,969 s.f. or 1.9 <br />acres. <br />The Orono Planning Commission reviewed this application on September 15, <br />1997 and recommended approval of the proposed variance based upon the <br />following findings: <br />1.The proposed addition would not increase encroachment by the residence <br />on the swimming pool beyond what is existing. <br />Page 1 of 5
