L <br />L if <br />■ : <br />2. <br />4. <br />5. <br />6. <br />7. <br />The zoning lot can continue to be used for residential use without the storage building. <br />The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The Zoning Code limits the size of accessory structures. The proposed storage building <br />exceeds the allowed maximum size, encroaches 7' into the required front yard and <br />exceeds tue height requirement based on the principal structure. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The va-iance for a 4,032 sq. ft. oversized accessory structure that exceeds the 1,600 sq. ft. <br />limitation to locate within 23' of the front property line and also exceeds the height of the <br />principal structure will change the character of the area. <br />Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />The applicant has not indicated whether economic factors are a consideration with this <br />application. <br />Undue hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for solar energy systems. <br />Solar access is not a consideration. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />The applicant has indicated that the storage building is for his personal belongings. <br />However, a building of this size would appear commercial in nature and may encourage <br />future owners to attempt to locate commercial uses in the building. <br />The Board or Council may permit as a variance the temporary use of a one-family <br />dwelling as a two-family dwelling. <br />Not applicable. <br />#2284 James Slechta <br />3700 Northern A venue <br />PC-9/15/97 <br />page-4
