r <br />4. <br />5. <br />6. <br />A.There is currently no enclosed storage for vehicles on the lot for <br />protection from the elements. <br />B.The zoning lot does not conform to lot vvidth requirements for the LR-IB <br />Zoning District. <br />C. The topography of the lot limits the location of the structure. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />The City Council finds that granting a conditional use ^rmit to allow an <br />accessory structure on a through lot will not be detrimental to the health, <br />safety or general welfare of the public, would not adversely affect light, air <br />nor pose a fire hazard or other danger to neighboring properties, nor will its <br />use depreciate surrounding property values and that the proposed level of use <br />of the property will be in keeping with the intent and objectives of the <br />Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planmng Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variances on the health, safety <br />and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances for height and location of an accessory structure in front of a principal <br />structure to Municipal Zoning Code Section 10.03, Subdivisions 9 (B& D); and a conditional <br />use permit for locating an accessory structure on a through lot per Section 10.03, Subdivision <br />10 to permit construction of a 26' x 38' detached garage, subject to the following conditions: <br />Page 2 of 5 <br />J <br />J
