1' <br />A RESOLUTION AMENDING CITY POLICY REGARDING <br />INCLUSION OF PROPERTIES IN A SANITARY SEWER PROJECT <br />sewerWHEREAS, the city has had a policy requiring inclusion of properties in sanitary _ <br />projects with the exception of a property on the fringe of the project area if the property has a <br />minimum of 2 acres, a septic system meeting all code requirements, and an alternate septic site, and <br />WHEREAS, the city has found that the timing of a sewer project is not always in sync with <br />the timing of the need for septic system replacements, so that project areas tend to include a small <br />number of properties with recently upgraded septic systems, and <br />WHEREAS, those properties with recently upgraded septic systems may determine it is in <br />their interest to opt out of the project to avoid paying a sewer assessment in addition to the recent <br />cost of upgrading their septic system, and <br />WHEREAS, it is reasonable to allow properties with recently upgraded septic systems that <br />meet all current code requirements to opt out of a sewer project, and <br />WHEREAS, it is not in the best interests of the city that a small number of properties with <br />recently upgraded septic systems prevent a sewer project, that would benefit a large number of <br />properties, from moving ahead, and <br />WHEREAS, if a property that opted out of a sewer project desires to connect to the sewer <br />project in the future, the property should pay the full per umt project cost as a connection charge. <br />NOW, THEREFORE BE IT RESOLVED, that the Orono City Council does hereby <br />amend the city policy regarding the inclusion of properties in sanitary sewer projects to enable a <br />property within a sewer project area to opt out of the project if the property has a septic system that <br />meets all current code requirements and is less than 7 years old. <br />BE IT FURTHER RESOLVED, that if the owner of the opt out property decides at any <br />time in the future to connect to the sewer system, the property will pay a connection charge equal <br />to the full per umt cost of the initial sewer project increased by a cost of living factor on an annual <br />basis.
