r <br />S .A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.24, SUBDIVISION 5 (B) <br />FILE #2255 <br />WHEREAS, Richard B. Rice and Deborah Rice (hereinafter "the applicants") <br />are owners of the property located at 2700 Kelly Avenue within the City of Orono hereinafter <br />"City") and legally described as follows: <br />Lot 8, Vem-Mar Manor, Hennepin County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a variance from <br />Municipal Zoning Code Section 10.24, Subdivision 5 (B) to build a deck on the west and north <br />side of an existing residence. Variances for a rear yard setback to reduce the required yard <br />from 25' to 21’ where 30’ is required; and a side yard adjacent to a street (Lydiard Avenue) <br />setback to reduce the required comer side yard from 30’ to 21’ where 30’ is existing are <br />required. <br />Minnesota: <br />1. <br />2. <br />3. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />This application was reviewed as Zoning File #2255. <br />The property is located in the LR-IB, One Family Lakeshore Residential Zoning <br />District where the minimum lot area requirement is 1 acre. The lot area is <br />22,324 s.f. (.512 acres). <br />The Orono Planning Commission reviewed this application on August 18, 1997, <br />and recommended unanimous approval of the proposed variances based upon the <br />following unique findings and hardships; <br />Page 1 of 4
