MINUTES OF THE REGULAR ORONO CITY COUNCIL <br />MEETING HELD ON JLXY 28,1997 <br />PUBLIC COMMENTS <br />Mike Barrett Continued <br />Greg Gappa said it was his understanding that the City has not maintained the road but <br />will follow up on the issue. <br />Jabbour instructed Staff to review the facts and make a recommendation. He asked that <br />the affected residents be notified prior to the August 11 meeting if the issue can be <br />resolved. <br />Khosrow Daivar, 1082 Loma Linda, informed the Council he had added a screened in <br />area on his deck and the work was stopped by the building inspector, who informed him <br />of the need for a building permit and a variance from the average lakeshore setback <br />requirement. The screened area is complete except for painting. Daivar said his <br />property is on a peninsula. Daivar said he spoke with Van Zomeren of the need to make <br />an application for a variance and provide a survey of the property. Daivar feels the law <br />should be changed. He indicated he feels he has a hardship regarding the screened area. <br />Jabbour informed Daivar that only the building inspector can make the determination <br />regarding the need for a building permit. <br />Barrett agreed that a building permit cannot be waived, but if denied, it can be appealed <br />to the Council. <br />Daivar vc’ced his concern with the cost of the application. He feels the process is a <br />h^Mship. <br />Jabbour noted the purpose of the law and his support of it. <br />Goetten reiterated that the work was begun without obtaining a permit, and Daivar was <br />notified of his need for a variance. <br />Daivar said he did not think he needed to have a building permit.
