Zoning File #2259 <br />July 15,1997 <br />Page 4 <br />Staff Recommendation <br />In staffs opinion there are few circumstances in which it is appropriate to reduce the side yard to 5’ <br />for a principal structure in any zoning district, much less the 2-acre zone. Even in Orono's 1/2 acre <br />zones, the minimum side setback requirement is 10'. This is a neighborhood of substandard 1 acre <br />lots in the middle of a 2 acre zone, and the proposed addition will in staffs opinion tend to have a <br />negative impact on the visual density of the neighborhood. <br />Planning Commission must determine whether sufficient hardship exists to support the requested <br />variances. Planning Commission may wish to consider whether some setback relief is warranted, <br />and if so, suggest that the applicants consider providing a revised proposal. <br />Options for Action <br />1. Recommend approval as requested. <br />2. Recommend conditional approval/partial approval. <br />3. Table for revisions or further information. <br />4. Recommend denial (state reasons). <br />5.Other. <br />Given that the septic system is failing, it would be appropriate to condition any recommendation for <br />approval on concurrent upgrade of the septic system.
