\ <br />Request for Council Action continued <br />Page 2 <br />August 8,1997 <br />Zoning File # 2269 Conley Brooks, Jr. and Gerald McCourtney, 980/1045/1055 West Femdale <br />_____Road - Subdivision of a Lot Line Rearrangement______________________________ <br />Planning Commission Recommendation <br />Planning Commission reviewed this request at their July 21 meeting, and on a vote of 6 to 0 <br />recommended approval only of the basic proposed division/recombination of the 1045 parcel <br />south of the road per the original lot line separating Lots 11 and 12, North Shore Cottage <br />Acres Lake Minnetonka. The approval is subject to: <br />1. The westerly portion being legally combined with the McCourtney property. <br />2. McCourtney to remove the existing residence on tliat property. <br />3. That the easterly portion be combined with Brooks' residence and the two <br />northerly parcels of 1045. <br />4. That if Hennepin County will not allow this combination across the roadway that <br />Brooks must complete a "Special Lot Combination" for filing in the title of <br />those parcels (identified as Parcels A, E, H and F on the submitted survey). <br />5. Regarding the existing garage on Parcel H, Planning Commission agreed that it <br />needs to be removed, but acknowledged Brooks may want to leave it as is until <br />he firms up his plans for potentially replacing it. As a result, Plying <br />Commission did not make removal of the existing garage a condition of <br />approval. <br />6. Planning Commission and staff made it clear that the recommendation for <br />approval does not include approval of, or implied approval of, any actions in <br />regard to Parcels B, C or D as shown on the survey, each of which does not <br />appear on current County plat maps as a separate tax parcel, and each of which <br />may require City action or approvals as yet undetermined. <br />The basis for Planning Commission's conclusion included how the proposal meets the zoning <br />district lot area and wddth standards, and whether the properties to be recombined are adjacent <br />and eligible for combination. The McCourtney property is directly adjacent. The Brooks <br />property upon combination of Parcels A, E and H will be directly across Femdale Road from <br />Parcel F. Many similar lot arrangements exist in Orono, and it has long been the Citys <br />practice to recognize 'adjacency' of commonly owned parcels directly across the road when one <br />of the parcels is merely a lakeshore strip. Planning Commission could easily confirm that the <br />McCourtney property would end up with a lot that meets the 200' width stand^d, although it <br />does not gain enough acreage to meet the two acre standard.
