Gaffron, Assistant Planning & Zoning Administrator <br />Date:July 16, 1997 <br />Subject:#2187 Donald and Robin Helgager, 3265 Sixth Avenue North - Variances <br />Continuation of Public Hearing - Plan Revisions <br />Zoning District: RR-IB, Single Family Rural Residential, 2 Acre, (Jnsewered <br />Application: Applicants have withdrawn their proposal for constructing a guest apartment, and <br />have revised their current application. The new proposal is for construction on <br />the footprint that was eqjproved in June 1996 (Resolution No. 3737) but with the <br />addition of a second story over the attached garage addition. This plates <br />additional bulk of structure encroaching the 30' side setback, hence the need for <br />this additional variance review. <br />List of Exhibits <br />A - Architect’s Letter of Request <br />B - Survey/Site Plan/Revised Building Plans <br />C - Building Plan Approved in June 1996 <br />D - Resolution No. 3737 <br />E - Planning Commission Minutes 11/18/96, 1/21/97, 2/18/97 <br />F - Council Minutes 3/10/97 <br />G - 60-day review Period Waiver 3/11/97 <br />H - Notice of Council Action 3/14/97 <br />Discussion <br />The 1996 approval included a side setback variance to allow the construction of a new attached <br />garage and room additions 5' from the east side lot line where the required side setback is 30'. <br />The existing house is 27.3* from that side lot line, and the existing garage (to be removed) is <br />6.8* from the lot line. <br />The 1996 approval also granted a variance to the 150' Natural Environment Lake setback to <br />allow the additions to be located 140* from Lake Classen. The justification for this variance <br />was removal of the existing detached garage which encroaches within 123' of the OHWL. <br />The 1996 approval also granted an average lakeshore setback variance, justified on the basis <br />that the removal of the existing garage and subsequent construction of the new attached garage <br />and room additions would result in less encroachment of the average lakeshore setback than <br />currently exists, with the likelihood of additional views of the lake opened up to the easterly <br />:i
