The proposed <br />antenna location is 55.26 ’ from the north property line where 70’ is required. <br />Height <br />The proposed height of the antenna tower is 65 ’, with 70’ the total height. The Code limits height <br />for amat?«ir radio towers to 65 ’. A 5 ’ variance in height is required. However, the antenna will only <br />be at the maximum height when in use because it is retractable. <br />STATEMENT OF HARDSHIP <br />See applicant’s Statement of Hardship, Exhibit L. <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The property is zoned residential and it can continue to be used as a residence. The applicant <br />indicates that he needs a 70’ tower to engage in amateur radio. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The applicant's property is pie-shaped with the rear yard narrower than the front yard. The <br />yard slopes to the rear where there is a wetland. The requested height of the tower is based <br />on the applicant's proposed amateur radio use. <br />3. The variance, if granted, will alter the essential character of the locality. <br />The variarice for antenna setback and height will change the character of the area.
