4. <br />B. The only feasible site for replacement of the existing system is 97' from <br />the Ordinary High Water mark of French Lake. <br />C. Zoning Code Section 10.56, Subdivision 16 (C) requires that any septic <br />system be located at least 150 ’ from a Natural Environment Lake. The <br />property was developed prior to adoption of the 150' setback, and the <br />configuration and layout of existing improvements on the property make <br />it impossible to locate a septic system at a conforming location on the <br />property. <br />D. The proposed system has been designed to meet all the pertinent State <br />standards. <br />E. Granting of the proposed variance will have no impact on neighboring <br />properties and will have a positive impact on the quality of French Lake <br />by allowing the replacement of non-conforming septic system with one <br />that is expected to provide adequate sewage treatment in all anticipated <br />ground water conditions. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the conununity. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 4
