The applicant is proposing to add hardcover in the 0-75' setback where 555.5 ft. is existing and 569 <br />ft. is proposed for an increase of 13.5 ft. The amount of hardcover proposed in the 0-75' setback <br />represents 4.06% of the lot area in the setback. The applicant is also proposing to add hardcover in <br />the 75-250' setback, however, no variance is required. <br />STATEMENT OF HARDSHIP <br />The applicant has indicated that the house was built in front of the adjacent properties. The applicant <br />states that the proposed improvements will not impact the sight lines of either adjacent property. <br />The applicant notes that on the survey the deck and stairway appear to be farther than 75' from the <br />lakeshore because of the topography. <br />Criteria for Determining I Jntliie Hardship <br />1.The property in question cannot be put to a reasonable use if used under conditions allowed <br />by the official controls. <br />The property can continue to be used for residential use without the improvements. The <br />applicant should provide testimony as to the reasonable use of the structure without the <br />improvements. <br />2.The plight of the landowner is due to circumstances unique to his property not created by the <br />landowner. <br />The lot is irregular shaped and has steep slopes to the shoreline. The house was constructed <br />before the current regulations. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The variance for hardcover in the 0-75' setback, average lakeshore setback, and lakeshore <br />setback will not change the character of the area. <br />4.Economic considerations alone shall not constitute an undue hardship if reasonable use for <br />the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />Undue hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for solar energy systems. <br />Solar access is not a consideration. <br />M2243 John D.
