2. That the proposed location of the conditional use and the proposed condition under <br />which it would be operated or maintained would not be detrimental to the public health, <br />safety, or welfare, or materially injurious to properties or improvements in the vicinity. <br />The proposed operational plan for the school will be compatible with the neighborhood. The <br />school should be limited to a maximum of 56 students or the maximum allowed by the Building <br />Code, whichever is less. The building and the site should not be expanded to be consistent with the <br />comprehensive plan. <br />3.That the proposed conditional use will comply with each of the applicable provisions of <br />the Zoning Chapter. <br />A variance has previously been granted for the parking area. A 15 ft. fence, as required by the <br />Zoning Code for public and private schools in not a practical consideration for this site and would <br />detract from the historical character of the structure. <br />Staff Recommendation <br />To approve the conditional use permit, subject to the following standards: <br />1.The building shall have a certificate of occupancy before the school relocates into <br />the building. <br />2.
