Minnesota: <br />1. <br />2. <br />3. <br />4. <br />5. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />This application was reviewed as Zoning Fite #2234. <br />The property is located in the LR-IB, One Family Lakeshore Residential Zoning <br />District where the minimum lot area requirement is 1 acre. <br />The Orono Planning Commission reviewed this application on May 19, 1997, <br />and recommended unanimous approval of the proposed variances based upon the <br />following unique findings and hardships: <br />A.The lot does not meet the minimiun lot area and lot size requirements for <br />the LR-IB Zoning District. <br />B.The current residence and garage do not conform to the setback <br />requirements from the side or street property lines. <br />C. The current driveway requires an casement over adjacent property. <br />D. The existing garage is located in the road right-of-w'ay. <br />The City Council finds that the conditions existing on lliis property are peculiar <br />to it and do not apply generally to other property in tliis zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />The City C< ■'.cil has considered this application including the findings and <br />recommendatio of the Planning Commission, reports by City staff, comments <br />Page 2 of 4
