C. This CUP is granted to Spring Hill Golf Club to operate a private, limited <br />membership golf course. Conversion of the property to a public golf course shall not <br />be allowed unless a specific revision of this CUP to allow such use is granted by the <br />City Council. <br />D. An amendment of this CUP will be required for construction of any future buildings <br />proposed for the site, or for enlargement or remodeling of the initially approved pricipal or <br />accessory buildings. <br />12. DEVELOPER'S AGREEMENT. Applicant shall execute a Developers Agreement with the <br />City defining specific expectations of the Developer and the City in relation to the <br />construction of the proposed public and private improvements associated with development <br />of the property. <br />13. Authorities granted by this variance run with the property not with the applicant, but are <br />permissive only and must be exercised by application for building permits and land alteration <br />permits within one year of the date of Council approval, or this variance and conditional use <br />permit will expire on tliat date (May 27,1998). <br />14. Violation of or non-compliance with any of the terms and conditions of this resolution shall <br />constitute a violation of the zoning code, shall automatically terminate any authority granted <br />herein, and shall be punishable as a misdemeanor. <br />15. The undersigned applicant has read, understood and hereby agrees to the terms of this <br />resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the <br />recording of this resolution in the Chain of Title of the property. <br />Adopted by the City Council of the City of Orono, Minnesota at a regular meeting <br />held on the 27th day of May, 1997. <br />ATTEST; <br />Dorothy M.
