^UP approval to limit the hours of construction to protect the peace and repose of the <br />neighborhood. <br />19. The Council finds that once constructed, the proposed private golf course use as <br />proposed, witn limited membership and limited activity as proposed, is compatible <br />with the rural residential character of the surrounding neighborhood. Council further <br />finds that should the level of activity or the size of the membership be proposed <br />to increase from the initially approved levels, it will be necessary for the applicant <br />to seek an amendment to this CUP prior to such activity being established. <br />20. The Council finds that the conditions existing on this property are peculiar to it and <br />do not apply generally to other property in this zoning district; 0 t granting the <br />requested variances would not adversely affect traffic conditions, ligm, air nor pose <br />a fire hazard or other danger to neighboring properties, would not merely serve as a <br />convenience to the applicant, but are necessary to alleviate demonstrable hardships <br />or difficulties; are necessary to preserve a substantial proper*’ rig,l.t of the applicant; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />21 . The City Council finds that granting conditional use permits to allow the construction <br />of and use of the property for a private golf course will not be detrimental to the <br />health, safety or general welfare of the public, would not adversely affect light, air <br />nor pose a fire hazard or other danger to neighboring property, nor will such <br />construction and use depreciate surrounding property values and that the proposed <br />level of use of the property will be in keeping with the intent and objectives of the <br />Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the City Council of Orono, Minnesota hereby <br />grants to Spring Hill Golf Club a conditional use permit per Municipal Zoning Code Sections 10.28 <br />Subd. 3 and 10.29 Subd. 1 to allow operation of a golf course within the RR-1 B and RR-1B-1 zoning <br />districts; and a variance to Section 10.03, Subd. 9 to allow construction of an individual acces.sory <br />structure of 10,000 s.f in footprint area where a maximum individual accessory structure footprint <br />Page 7 of 16
