Strommen <br />Executive Director <br />Lake Minnetonka Conservation District <br />900 East Lake Street <br />Wayzata, MN 55391 <br />RE: Rip Rap Permit at 2925 Casco Point Road <br />Dear Gene: <br />It is our understanding based on the most recently amended improvement plan that the rip rap project <br />will extend the OHWL a maximum of 8', even at the most indented piece of shoreline, and that no <br />attempt will be made to straighten the shoreline as prohibited by DNR regulations. <br />Any fill placed behind the rip rap or to the land side of rip rap is regulated by the City of Orono Land <br />Use Regulations Section 10.03, Subd. 19 as follows: <br />"It is unlawful for any person to ... change the grade or shore of lakeshore property <br />without a conditional use permit issued by the Council ...." <br />Also Section 10.56, Subd. 16 (J) (2) states: (also reference Section 10.56, Subd. 7 enclosed) <br />"Grading, filling and excavating is prohibited within 75' of the OHWL ..." <br />These specific ordinance section s are enclosed for your information.
