The subdivider may wish to <br />use the standard form used by the City for inclusion in the private <br />covenants. In addition, the City will expect private covenants to <br />address maintenance and protection of drainageways and retention areas <br />by private property owners. Upon preliminary approval of the plat, <br />the subdivider is to draft appropriate private covenants to be <br />submitted to the City prior to the City granting approval of v.he final <br />plat. <br />7. Applicant shall create a Homeowners' Association to ensure upkeep <br />and maintenance of private road. This document must provide for an <br />undivided share of the ownership of said road and future deed <br />transfering ownership of residential lots must include the undivided <br />or equal share in private road. <br />8. Subdivider to execute a drainfield covenant to be filed against <br />the Chain of Title of each of the 12 lots within the plat in order to <br />ensure future owners knowledge and awareness of the special <br />limitations on the septic capabilities of the rural lots and the need <br />to protect existing septic test sites. The City requests that the <br />following addition be made to the original septic covenant proposed by <br />applicant for original 16-lot plat. The following sentence is to be <br />added between sentences 1 and 2; <br />"In most cases, these are the only two feasible sites on ea.oh <br />lot, and must not be disturbed. The existing natural topsoil <br />must remain in place and must not be subject to any traffic which <br />will cause even the slightest compaction." <br />9. The subdivider shall m.aintain adequate erosion control per final <br />approved plans by Gerald M. Sunde throughout the construction of the <br />road, drainage improvements and until all ground cover disturbed on <br />the property is restored. <br />Page 4 of 8
