I have enclosed pertinent <br />sections of the file that provide direction on the future use of the existing residence structure on Lot <br />2. The enclosed exhibits are as follows: <br />A. Staff Memo May 3, 1995. <br />B. Resolution #3574 - Resolution granting preliminary approval. <br />C. Planning Commission Minutes of June 19, 1994. <br />D. Resolution #3609 - Final plat resolution. <br />The staff memo of May 3, 1995 refers to use of the existing structure as expanded living space if <br />kitchen was removed. The formal action of the Planning Commission, as stated in the enclosed <br />minutes, recommends that structure may bo incorporated as part of a future principal structure but <br />cannot remain as a separate guest house. The)' chose not to address the future use of structure as an <br />accessory structure w'ith expanded living space as the staff memo had noted. Condition 5 of the <br />Council Resolution #3574 adopted on July 10, 1995 reaffirms the Planning Commission <br />recommendation. Remember the existing principal structure was approved as meeting ail required <br />setbacks of the LR-1A zoning district. <br />Resolution #3609, Exhibit C, specifically Condition 3 of that resolution also restates the Cit>’’s <br />position on the existing residential structure on Lot 2. <br />As 1 noted to you in your recent visit to the City offices, the City has changed their policy on the use <br />of existing residential structures where a new residence is to be constructed and former primary <br />structure to remain as accessory. Council detennined that as long as the heating and plumbing were <br />removed, the structures can remain as accessor)' to the principal structure. At the December 1996 <br />meeting. Council directed staff to develop a review/application process that would provide for <br />appropriate standards and controls lor the use of accessory structures w'ith expanded living space. <br />Council did not adopt a moratorium ordinance nor was a deadline date established for staff. <br />Telephone (612) 473-7357 • FAX 473-0510
