April 14, 1997 <br />Page 2 <br />ordinance based on Subdhision work in that Citv. /Vlr. Radio <br />was involved in that matter, is familiar with the applicable <br />Minnetrista ordmance, and ctm ad\isc the City accordingly. <br />Based on that communication, the subject Application was tabled at the Februaiy <br />24, 1997 Council heating, and was rescheduled to be heard on March 10, with Staff and <br />the Applic^int’s attorney scheduled to meet oi\ February' 27. The February 27 meeting <br />was held at the Orono City Rail as scheduled. Present ^vcrc die City Administrator, the <br />City Attorney, tlie Building and Zoning Administrator - both outgoing and incoming - <br />and the undersigned, who appeared on behalf of the Applicant. At the meeting. City <br />Staff advi.vcd us that it had received an appraisal of the market value of the two Lots in <br />question. The appraisal was in the amount of $750,000.00. and Staff indicated its <br />intention to collect 8% of that an\ount. or $60,000.00. as a condition to subdivision <br />approval. This equates to $30,000.00 per Lot. <br />In response, we ptovidexi City Staff our memorandiun of Febmary 25, 1997, a <br />copy of w'hich is attached, which describes the park dedication ordinances of neighboring <br />municipalities. As noted in the memorandum, the park dedication fee ordinances range <br />from a low* park dedication fee of $500.00 per lot (\Iinnetonka) to a high park <br />dedication fee of $4,100.00 per lot (Miimetris-ta). These are in comparison to the <br />propo.sed fee of S30.000.00 per lot. The full comparison is as follows: <br />Minnetonka <br />Wavzaia <br />Minnetnsta <br />Orono <br />$500.00 <br />$2,000.00 <br />$4,100.00 <br />530,000.00 <br />When we compared the proposed Orono fee to Wav^ata’s and iVlinnctrista's fees, and <br />observed a variance of 15 to 1 (Wayzata) and 7.3 to I (Minnetnsta). we felt we had no <br />choice but to question the proposed levy of a flat S% fee, and did so. How'ever, we <br />expressed at the time, and have cor.'.inued to so express, the hope that a reasonable <br />compromise could be agreed upon before the matter came on I'm- hearing before the <br />Council. <br />As the March 10 Orono City Council heaving was postponed to March 24, and <br />from March 24 to April 14, without any response from the City, our hopes for <br />eo’d 1989888219 ‘ON m ia3ddn*N01SNII1*SN0HIS 91^:81 HOW L^-n-W
