Radio, City Attorney <br />Regulation of Activities Within Harbors Located in Orono <br />OVERVIEW <br />The City Council has requested an opinion regarding its ability to regulate activities <br />within Orono ’s harbors. Based upon applicable statutes, regulations, and cases, the City of <br />Orono has the ability to impose reasonable restrictions on certain activities occurring in <br />Orono ’s harbors. <br />DISCUSSION <br />As a political subdivision of the State, the City of Orono must first look toward state <br />law for enumeration of its particular powers. The City’s power and authority concerning <br />harbors is found in Minn. Stat. § 412.221, subd. 12, which states: <br />The council shall have power to establish harbor and dock limits <br />and by ordinance regulate the location, construction and use of <br />peers, docks, wharfs and boat houses on applicable waters and <br />fix rates of wharfage.
