Request for Council Action continued <br />page 2 of 2 <br />March 19, 1997 <br />Item Valek Request to Vacate Right-of-Way and Acquisition of a Portion of a Tax Forfeit Parcel <br />a limited duration. The Park Commission has recommended the access through the church property <br />as a temporary pedestrian access and the Garden Lane right-of-way as the permanent access as the <br />best alternatives for park access. Both are superior to the Valek right-of-way. <br />Staff has not determined any other p-oiential use for the existing right-of-way on the Valek property. <br />However, there may be a need for an easement for drainage purposes due to stormwater flowing <br />through the '' 'alek property. Therefore, staff recommends favorable consideration of the Valek <br />request to vacate the right-of-way, subject to a determination regarding the need for a drainage <br />easement. <br />The vacation of the right-of-way on the Valek property will require an application for vacation of <br />right-of-way by the Valeks. <br />Valek Request to Acquire 1/2 Acre of the Tax Forfeit Parcel <br />If the Council agrees with the staff recommendation regarding the right-of-way on the Valek <br />property, the Council may want to make the 1/2 acre tax forfeit parcel available to the Valeks. This <br />can be accomplished by notifying the County to release the parcel for sale to adjacent property <br />owners. <br />Valek Subdivision Plans <br />The Valeks plan to propose a subdivision that would create an additional buildable lot by combining <br />portions of two existing substandard lots (see map C). The city policy regarding substandard lots <br />is that undeveloped existing lots of record need to have 80% of the minimum lot area to be buildable. <br />In this case, the two existing lots, if combined, would meet the 80% standard. The addition of the <br />1/2 acre tax forfeit parcel would enable both the Valek lot and the new lot to be increased in size. <br />The creation of an additional lot would require a subdivision process. <br />COUNCIL ACTION REQUESTED; <br />Motion to authorize the County to release the 1/2 acre portion of the 9.5 acre tax forfeit parcel for <br />sale to adjacent property owners.
