RESOLUTION REGARDING THE CITY ’S <br />APPLICATION FOR A NATURAL AND SCENIC AREA GRANT <br />WHEREAS, there is an existing 12 acre natural area in the Saga Hill area; and <br />WHEREAS, there are two undeveloped parcels adjacent to the natural area that could <br />require access from Garden Lane right-of-way, which runs through the middle of the existing natural <br />area; and <br />WHEREAS, a solution to this problem is the acquisition of the parcels to be added <br />to the existing natural area; and <br />WHEREAS, a potential source of funding for the acquisition is the Natural and <br />Scenic Grant Program. <br />NOW, THEREFORE, BE IT RESOLVED, that the City of Orono act as legal <br />sponsor for the project contained in the Natural and Scenic Area Grant Program Application to be <br />submitted on March 31, 1997 and that the City Administrator is hereby authorized to apply to the <br />Department of Natural Resources for funding of this project on behalf of the City of Orono. <br />BE IT FURTHER RESOLVED, that the City of Orono has the legal authority to <br />apply for financial assistance, and the institutional, managerial, and financial capability to ensure <br />adequate acquisition, maintenance and protection of the proposed project. <br />BE IT FURTHER RESOLVED, that the City of Orono has not incurred any costs, <br />and has not entered into any written agreements to purchase property proposed by this project. <br />BE IT FURTHER RESOLVED, that the City of Orono has not violated any <br />Federal, State, or Local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of <br />interest or other unlawful or corrupt practice. <br />BE IT FURTHER RESOLVED that upon approval of its application by the state, <br />the City of Orono, may enter into an agreement with the State of Minnesota for the above-referenced <br />project, and that the City of Orono certifies that it will comply with all applicable laws and <br />regulations as stated in the contract agreement and described in the Compliances section of the <br />Natural and Scenic Area Grant Program Application. <br />Page 1 of 2
