DT <br />DATE Ac?/-^7 <br />ATTACHMENT A <br />CONDITIONS FOR GENERAL PERMIT #97-6098 <br />(Page 1 of 3) <br />GENERAL <br />1. <br />2. <br />3. <br />4. <br />5. <br />6. <br />7. <br />8. <br />9. <br />All appropriate licenses or approvals from the Lake Minnetonka Conservation District and from the City in which <br />the project Is located must be obtained prior to commencing the project. <br />Erosion control measures shall be adequately designed for the site characteristics. They may include staked <br />haybales, diversion channels, sediment ponds, or sediment fences. They shall be installed in accordance with <br />"Protecting Water Quality in Urban Areas - Best Management Practices for Minnesota" MPCA, October 1989, <br />prior to commencement and maintained throughout the project. All exposed soil shall be stabilized as soon <br />as possible and no later than 72 hours after the completion of the project. Soil stabilization shall be achieved <br />by mulching and seeding or placement of sod at the rates or manner prescribed in the above referenced <br />guidance document on erosion control or by other accepted manner defined in said document. Topsoil should <br />be used to re-dress disturbed soil areas and indigenous plant species should be used to revegetate disturbed <br />areas whenever possible. <br />No removal or deatmetlon of aquatic vegetation is permitted unless an Aquatic Management Permit is <br />obtained from DNR Regional Fisheries Office (@ 772-7950), or the removal consists or mechanical (i.e., not <br />chemical) removal of submerged or floating aquatic vegetation that meets the conditions for not requiring a <br />permit (i.e., mechanical removal of submerged or floating aquatic vegetation in an area of less than 2,500 <br />square feet). Note: Removal of any amount of emergent vegetation is prohibited unless an aquatic plant <br />management permit has been obtained from DNR Fisheries. <br />Project equipment shall be inspected for Eurasian water milfoil, zebra mussels and other exotics, and <br />decontaminated prior to and following project completion and/or when equipment is moved from one waterbody <br />to another. Every reasonable precaution shall be taken to prevent inoculation of other waterbodies. DNR- <br />Ecological Services (612-296-2835) may be contacted for information on how to decontaminate equipment. <br />The permittee shall monitor all disturbed areas for the presence of purple loosestrife and control the plant. The <br />DNR aquatic plant manager should be contacted at 772-7950 for permit needs and additional information. <br />The permittee is authorized to maintain the approved work to the dimensions in the LMCD license. Prior to <br />commencing any maintenance work, the permittee shall advise the Lake Minnetonka Conservation Distrirt of <br />the extent and method of maintenance. The maintenance shall not be commenced until permittee receives <br />written approval from the Lake Minnetonka Conservation District. The LMCD shall copy the DNR Area <br />Hydrologist and the Conservation Officer on such maintenance approvals. <br />The DNR Area Rsheries Manager will be given an opportunity to review the proposed plans to help ensure that <br />no posted spawning areas or other significant fish or wildlife habitat is affected. <br />Structures (docks, ramps, etc.) shall not be constructed with materials that would have a detrimental impact <br />on aquatic organisms or water quality. <br />Placement of structures not permitted. Placement of structures shall not be permitted where the structure: <br />(A) VVill obstruct navigation or create a water safety hazard. <br />(B) Will be detrimental to significant fish and wildlife habitat, or protected vegetation. Construction Is <br />prohibited in posted fish spawning areas. <br />(C) Is designed or intended to be used for human habitation or as a boathouse. <br />(D) Is designed or Intended to include walls, a roof, or sewage facilities.
