Zoning File #2213 <br />March 10,1997 <br />Page 2 <br />This structure will have no impact on tlie floodway of Lake Minnetonka and it will not increase the <br />flood height of the lake. <br />DNR General Permit <br />The DNR has issued a 'blanket' general permit for certain types of projects which will not require <br />DNR permits on Lake Minnetonka. These projects include seasonal docks, soipe permanent docks, <br />boat ramps, and multiple mooring facilities and marinas that meet certain criteria (See Exhibit F). <br />The LMCD administers this general permit. Depending on whether DNR considers the proposed <br />dock as "a single linear structure", it may require a separate DNR permit. <br />Boathouse Non-conformity Advisory <br />It should be noted for the record that the existing boathouse to which the dock will be attach'*d, is <br />a non-conforming structure under Orono Code Section 10.55 Subd. 9. Although a building permit <br />was issued for its construction in 1961, the boathouse has been non-conforming at least since the <br />Floodplain Ordinance was adopted in 1979, and perhaps much longer. This building is subject to <br />the non-conforming structure limitations imposed by Section 10.55 Subd. 26. <br />Staff Recommendation <br />Staff recommends approval of the proposed installation of a permanent dock adjacent to the <br />boathouse for Jim Zimmerman at 2745 Shadyw'ood Road, subject to applicant providing written <br />confirmation that any permits necessary from the DNR and LMCD have been obtained, prior to City <br />issuance of the required building permit; and subject to no concurrent work on the boathouse allowed <br />without a separate permit review and approval.
