Planning & Zoning Administrator <br />Administrator Reviewed:Agenda Section: <br />Zoning <br />Item Description: /j^2213 Jim Zimmerman, 2745 Shadywood Road - Conditional Use Permit - <br />Resolution <br />Zoning District: LR-IB, Single Family Lakeshore Residential. <br />Application: Request for conditional use permit for construction of permanent dock on Lake <br />Minnetonka per Section 10.55, Subd. 9(B-3). <br />List of Exhibits <br />A - Resolution <br />B - Memo and Exhibits of 3/10/97 <br />Brief Review of Application <br />Applicant proposes to construct a permanent boat dock adjacent to his existing boathouse located <br />in tlie lagoon area. The proposed dock will parallel the shoreline in order to avoid impacting boat <br />traffic in the lagoon area. <br />An LMCD permit has been applied for, and LMCD staff is currently reviewing whether a DNR <br />permit will be required or whether this dock falls under DNR's General Permit for certain <br />structures onLake Minnetonka. <br />Planning Commission Recommendation <br />Plaiming Commission reviewed this application at their March 17th meeting and unanimously <br />recommended approval subject to the following: <br />1.Applicant to obtain any permits necessary from the DNR and LMCD prior to City <br />issuance of the required building permit. <br />2.Applicant is advised that no concurrent work on the boathouse is allowed without <br />a separate permit review and approval, and the boathouse is subject to the City's <br />regulations regarding non-conforming structures.
