Request for Council Action continued <br />page 3 of 4 <br />February 4, 1997 (Updated 3-5-97) <br />Zoning File #2202 <br />4. <br />will be maintaining proper drainage and that the majority of wetlands to be impacted are <br />adjacent to existing County Road 15 and railroad right-of-way where their loss is likely <br />not as critical as might be the case with other wetlands in the City. <br />Planning Commission agreed that City approval should be conditioned on applicants <br />obtaining all the necessary permits from other regulatory bodies. <br />Staff Recommendation <br />Statf generally concurs with the conclusions of the Planning Commission, and staff recommends <br />approval of this project, with the following items for Council discussion: <br />Should the City pursue an early agreement with MCWD regarding the use of Orono- <br />generated mitigation funding for Orono projects? <br />rg»ggjriiia i ■ n lyiar m <br />- * • Given that any significant delays in approval of the County Road 15 project rnay'reSlilt ’fti’P'^--^-^ • <br />it not happening at all, will Council accept Hennepin County’s current mitigation plan? <br />Staff was advised by the DNR just prior to the Planning Commission meeting, that this project <br />is subject to a mandatory Environmental Assessment Worksheet (EAW) due to the total amount <br />of wetland filling occurring. That EAW process is underway. However, the 30-day comment <br />period will not be completed until Wednesday March 12, with a final EIS decision by the County <br />still a few weeks away. EQB regulations prohibit cities from granting final approval of a project <br />until the EAW process is complete (see Exhibit C). Council has two options: <br />1.Delay adoption of a formal resolution of approval until the EAW process is <br />complete; or <br />2. Adopt a resolution that grants conditional approval subject to: <br />a. The City reserves the right to reconsider if the EAW process results in <br />changes in the project or mitigation measures that would reduce or avoid <br />environmental impacts that are disclosed through the EAW process. <br />b. City approval is conditioned on the completion of the environmental review <br />process in accordance with State statutes. <br />c.The City's conditional approval shall not preclude any other governmental
