Feb-ZO-97 03: BSP City o-f Minnetirista 44S-1311 P.Ol <br />RESOLUTION NO. <br />A RESOLUTION OPPOSING <br />VENDING OF FOOD OR MERCHANDISE <br />FROM WATERCRAFT ON LAKE MINNETONKA <br />WHEREAS, the Lake Minnetonka Conservation District has <br />received a request to allow vending of food and/or merchandise from <br />watercraft on Lake Minnetonka; and <br />WHEREAS, the vending of food and merchandise from watercraft <br />on Lake Minnetonka is inherently unsafe due to the following aspects of <br />such activity: <br />1. <br />2. <br />It requires that two or more boats approach each other and <br />remain in close proximity to one another, and may bring <br />multiple boats together in a small area which is inherently <br />dangerous. <br />It will tend to occur in the most congested areas of the lake <br />in order to be financially feasible, creating an even more <br />congested situation; and <br />WHEREAS, any attempt to minimize the inherent un.safc a.spccts of <br />sales activity in the open lake by moving .such activity near the shoreline <br />will have a negative impact on the enjo>'nicnt and repose of Minneirisia's <br />and other lake community residential lakcshore property owners by <br />creating undue activity, commotion, noise, litter, e.xhaust fumes, etc.; and <br />WHEREAS, Minnctrisia’s shoreline is zoned for .single family <br />residential u.scs; and <br />WHEREAS, the City ’s lakeshorc land use regulations, including <br />multiple dock regulations, are re.strictivc in order to protect the lakeshore <br />area; and <br />WHEREAS, the permitting of the vending of food and/or <br />merchandise from watercraft on Lake Minnetonka would be in total <br />conflict with the City's lakeshore land use regulations; and <br />WHEREAS, it is in the public interest that vending activity on Lake <br />Minnetonka be prohibited due to the safety concerns and negative public <br />impacts noted above. <br />Hi <br />A <br />•a <br />& <br />K <br />‘JL <br />p <br />% <br />SCL <br />V <br />A <br />Q <br />(V <br />0 <br />Ni <br />V. <br />I <br />§ <br />> <br />X
