5. <br />6. <br />7. <br />8. <br />9. <br />Applicant shall grant to the City a 10' easement for future trail purposes along <br />the northeasterly boundary of the 2380 Shadywood Road property adjacent to <br />Olive Avenue. <br />Applicant shall grant to the City a 10' wide trail easement centered on the <br />centerline of the sidewalk/bike path to be located near the northwesterly <br />boundary of the 2380 Shadywood Road property. <br />Although the City is being granted trail easements over the pedestrian and bike <br />pathway, that path within applicant's property boundaries shall be maintained by <br />the property owner, not by the City. It is the City's intent that all upkeep, <br />maintenance and snow removal activity will be the responsibility of the property <br />owner, not of the City. <br />Applicant shall legally combine the vacated portions of right-of-way with the <br />adjacent 2380 Shadywood Road property. <br />Applicant shall be responsible for e.xecuting the appropriate drainage, utility, <br />access and pedestrian/bike trail easements as noted above. Such easements shall <br />be filed at the time the vacation resolution is filed by the City Attorney's Office. <br />Adopted by the City Council of the City of Orono, Minnesota at a regular <br />meeting held January 13, 1997. <br />ATTEST: <br />Dorothy M.
