Section 8.Chapter 9 of the Orono Municipal Code entitled "Public Protection, Crimes and <br />Offenses" is hereby amended by the addition of the following Section: <br />SECTION 9.24 NOISE CONTROL <br />Subd 1. Definitions. Except as provided in this seciion, words or phrases used in <br />this chapter and defined in the rules of the Minnesota Pollution Control Agency Noise <br />Section, Chapter 7030, shall have the mea.iings given in those rules. As used in this <br />Ordinance the following words and phrases shall mean: <br />A. <br />C. <br />D. <br />E. <br />G <br />H <br />I. <br />Cut-Out or By-Pass. Mechanism which varies the exhaust system gas <br />flow so as to discharge the exhaust gas and acoustic energy to the <br />atmosphere without passing through the entire length of the system <br />including all exhaust system sound attenuation components. <br />B. dB (A). A unit of sound level expressed in decibels (dB) and A-weighted. <br />Excessive Noise. The presence of any noise or combination of noises in <br />such quantity, at such levels, or such nature and duration or under such <br />conditions as could potentially be injurious to human health, safety, or <br />welfare; ^r to animal life; or could interfere unreasonably with the <br />enjoyment of life or property. <br />I xhaust System. Combination of components which provides an enclosed <br />flow of exhaust gas from engine parts to the atmosphere. <br />Holiday. Any day fixed by the United States or by Minnesota State Law <br />for suspension of business in whole or in part. <br />F. MPCA. Minnesota Pollution Control Agency. <br />Municipality. The City of Orono. <br />Noise. Any sound not occurring in the natural environment, including but <br />not limited to, sounds emanating from airways, roadways, waterways, <br />industrial, commercial and residential sources. <br />Noise Control Officer. The Noise Control Officer shall be any of the City <br />employees authorized to issue citations as listed in Municipal Code Section <br />2.38 Subdivision 2. <br />Page 2
