Box 66 <br />Crystal Bay, MN 55323 <br />RE: PARTIAL VACATION OF MAPLE AVENUE - TRACT 05, CITY OF ORONO <br />(see Plat map attached) <br />Page 1 <br />May 25, 1984 <br />We the undersigned, hereby submit a formal petition to vacate Maple <br />Avenue. Along with the Plat m»ip, we have enclosed formal application <br />and a certified properties* owners list. <br />The proposal in this petition is to return the partially vacated Maple <br />Avenue back to the respective abutting property owners and is made <br />for the following reasons: <br />1. Currently Maple Avenue serves no useful purpose to the <br />City of Orono or it*s abutting property owners; <br />2. Maple Avenue has become a thoroughfare for three wheel <br />all terrain vehicles (ATV's), motor cycles and in the <br />winter - snowmobiles. The missuse of Maple Avenue in <br />this way leads these vehicles to trespass on the respective <br />abutting properties; <br />A <br />3. The abutting properties, as well as the piece of property <br />owned by the DNR are subject to noise nuisance, invasion <br />of privacy and, most important, destruction of foliage <br />and ground cover, (spring rains and thaw brings mud and <br />erosion, all of which is washed into Lake Minnetonka; <br />4. As owners of the abutting properties, we face possible <br />liabilities when these vehicles trespass on our property <br />in the event one of the drivers is hurt in any way; <br />5. If tlie vacation were approved, peace and (|uict would be <br />restored, as well as the landscape, whicli we sought to enjoy <br />when we purchased our properties; <br />We would be most willing to grant the City of Orono an easement over the <br />vacated portion of Maple Avenue for use in servicing any water/sewer <br />systems.
