Jabbour amended his motion to include <br />Barrett's responsibility to see thk^e easement be provided by the homeowners <br />mentioned to the residents of the subdivision. Vote: <br />Ayes 4, Nays 0. ______________—------------- <br />(#7) #2301 GERALD MCdOURTNEY, 1055 WEST FERNDALE ROAD - <br />VARIANCES - RESOLUTIOWNO. 3987 <br />The applicant was present. <br />/ <br />X / <br />Gaffron reported that the request for vari^ces includes landscaping within the right-of- <br />way of Femdale Road, expansion of drivev^qv apron in right-of-way, and construction of <br />a gate access within 75' of the lakeshore and o\jdie right-of-way. Legal combination of <br />the properties carmot occur until court action ha^dsolved the ownership of property in <br />question. Gaiffron noted that the apron will matcXjhe other side of the driveway <br />allowing for better approach. The landscaping >^ln^ an arborvitae hedge set at 15-17* <br />from the paved roadway. The right-of-way is 66'. Tn^gated access will remain grassy <br />and allow for entry by private maintenance personnel. <br />Gaffron said the Planning Commission recommended app)^al subject to the two tax <br />parcels being legally combined once the court action has beehTmalized. The <br />Commission felt the removal of the hduse more than off-set th^dditional hardcover for <br />the apron, which greatly exceeds th^lotted amount for a garage'^ron. Per prior <br />variance approval, an apron is allowed at a 40' width, which proviae^ extra parking <br />space. St^ agreed with recomniendation subject to a hold harmless agreement signed <br />by applicant for the improvements within the right-of-way.
