The <br />tower would be located approximately 60' from the rear lot line (Luce Line Trail) and 65 feet from <br />the residential, side lot line (Lot 3). <br />ANALYSIS <br />Variance <br />STATEMENT OF HARDSHIP <br />The applicant's have included their statement of hardship in Exhibit A. The applicant should also <br />be asked for their testimony regarding this issue. <br />Tower Height and Location <br />The Zoning Code does not allow structures to exceed 30' in height. Section 10.75, Subd. 1 lists <br />several structures that are allowed to exceed the height standards described above. Section 10.7^ <br />is included as Attachment G. Wind towers are not addressed in the zoning code. Therefore it is <br />staffs conclusion that a height variance from the 30' maximum must be approved to allow such a <br />structure to be built. <br />Locating the tower within 90 feet of property lines may pose a potential public safety issue. <br />According to the specifications provided by the applicant, the survival wind speed for the tower is <br />120 miles per hour. If the tower would ever collapse it could fall onto the Luce Line Trail or the <br />neighboring property to the east. The propeller diameter is 14.8', meaning one propeller standing <br />erect would increase the height of the structure by 7.4'. <br />Surrounding Properties <br />The surrounding properties are zoned RR-IB.
