The applicant should also <br />be asked for their testimony regarding this issue. <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The property would allow the construction of the home meeting the Average Lakeshore <br />Setback requirement. Although this lot is unique as it is located on a point. The property <br />faces directly south towards the lake. The adjacent lot to the west faces to the southwest. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The property's sight lines are net affected by placing tlie home closer to the lake than the <br />Average Lakeshore Setback, ’’he setback line is affected by the lot to the west as the <br />property is not located directly adjacent to the applicant ’s property. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The variance would not change the locality, as the property would be ured as a single family <br />residential lot.
