The patio is <br />replacing a deck that was removed in the same location. Also variances are <br />necessary for hardcover in the 75-250' lakeshore setback to allow for the <br />patio and the reconstruction of an old garage. The garage would also require <br />a variance from the side yard adjacent to the street setback. <br />This application will also require a Conditional Use Permit for retaining walls <br />that have already been replaced on the property. Section 10.03, Subd. 19 of <br />the Zoning Code prohibits any repair or replacement of retaining walls on <br />lakeshore property without a Conditional Use Permit. The applicant has <br />stated old wooden retaining walls that were in disrepair were replaced with <br />concrete walls. It should be noted that the applicant did not do any grading <br />or filling on the property. Comparing a survey from 1996 to the new survey <br />it spears that several retaining walls have been added, to include the area <br />within 75' of the lake.
