Undue hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for solar energy systems. <br />10. <br />Solar access is not a consideration. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />The use of the property would remain residential, which is consistent with the zoning. <br />The Board or Council may permit as a variance the temporary use of a one-family <br />dwelling as a two-family dwelling. <br />The applicant will not be changing the dwelling status of the property. <br />The special conditions applying to the structure of land in question are peculiar <br />to such property or iimne^ately adjoining property. <br />The property does contain a unique characteristic as it is located on a comer, resulting in <br />the nearly all of the lot being located within the average lakeshore setback.
