(p <br />TO: <br />FROM: <br />DATE: <br />SUBJECT <br />Chair Smith and Orono Planning Commission Members <br />Ron Moorse, City Administrator <br />Liz Van Zomeren, City Planner/Zoning Administrator <br />July 16,1998 <br />KatUaiir <br />ind #2387 Busse Construction, on behalf of <br />larine Colgrove, 4260 Sixth Avenue North <br />Bob Gehrman, 4300 Sixth Avenue North <br />Conditional Use-Public Hearing <br />Zoning District: RR-IA One Family Rural Residential (5 acres) <br />Application:Busse Construction is working on the County Road 6 project for Hennepin <br />County. Due to the cut and fill process for the road work, Busse <br />Construction needs to find locations near the project to haul excess dirt. <br />Property owners in the area have requested fill. Land alteration of this <br />magnitude requires a conditional use permit. <br />The proposed land alteration will be located in the northeast section of the <br />Gehrman property and a portion of the rear yard of Colgrove's property. The <br />land alteration will require 17,310 cubic yards of fill. <br />Pertinent Ordinances: <br />• Section 10.03, Subd. 19 and 20 <br />Findings: <br />1. That the proposed location of the conditional use is in accord with the objectives of the <br />Zoning Chapter and the purposes of the district in which the site is located and <br />Comprehensive Municipal Plan; <br />The proposed location in the rear yard will level an area that slopes from 299.5 m to 295 m <br />from southwest to northeast in the northeast section of the Gehrman's property. There is a <br />wetland in the vicinity. The applicant will need to stake along the wetland and stay at least <br />26' away from the edge of the delineated wetland.
