Minn Stai. 471.633. (attached.) <br />By Minn. Stat. 471.635. the Legislature in 1993 provided that clUes may <br />"regulate by reasonable, nondiscriminatory, and nonarbitrary zoning ordinances, the <br />location of businesses 'Here firearms are sold by a firearms dealer. For the purposes <br />of this section, a firearms dealer b a person who is federally licensed to sell firearms <br />and a governmental subdivision is an entity described In sections 471.633 and <br />471.634. <br />Accordingly, I conclude that the City of Orono may address by zoning ordin^ce-Lhe locaUon <br />of businessea where firearms are sold by a firearms dealer. Such Zoning requirements would <br />need to meet the statutory requirements, end would likely need to "grandfather" in existing <br />dealers, Oiven the language of 471.633,1 do not believe that the City eould prohibit the sale <br />of ammunition per sc. but could zone the location of business where firearms dealers sell <br />ammunition. <br />inO/98 <br />.
