Criteria for Determining Undue Hardship <br />1.The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />2. <br />4. <br />5. <br />6. <br />The property can continue to be used as a residence. The applicant wants to add more space <br />to the house. <br />The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The need for variances is created by the lot size, lot width, amount of existing hardcover, <br />topography, and location of the existing residence. The applicant has designed the addition, <br />however, to further encroach on the average lakeshore setback and bluff <br />3.The variances, if granted, will not alter the essential character of the locality. <br />The variance for hardcover, bluffsetback and average lakeshore setback will not change the <br />character of the area. <br />The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining property. <br />The adjacent property is also subject to a bluff setback This residence is forward of the <br />average lakeshore setback, however, it is due to the house to the west being located closer <br />to the lake at 65'and the house to the east located at 130'. This residence is approximately <br />80'from the lake. <br />The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />All lakeshore lots are subject to average lakeshore setback and hardcover regulations.
