It would not be possible for <br />the applicant to place the addition over any other portion of the residence without a variance. <br />6.The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />Generally residences will meet required setbacks in the zoning district. This property does <br />not due to the original construction occuring prior to the current zoning regulations. <br />7.The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />The granting of the variance is not necessary to enhance the use of the structure. It is to <br />create more living space within the residence. <br />8. The granting of such variance will not merely serve as a convenience to the applicant, <br />but is necessary to alleviate demonstrable hardship or difficulty. <br />The appicant has proposed to increase the size of the residence by expanding vertically. The <br />building footprint and hardcover on the property will not change if variances are approved. <br />Issues <br />1.The 2nd story addition will be placed directly above the current structure located within the <br />average lakeshore setback of the adjacent properties. <br />2.
