2. <br />4. <br />5. <br />6. <br />7. <br />The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The property does contain a unique characteristic as it is located between two roadways. <br />The south side of the property is Lakeview Terrace, where access is available to the <br />property. The north side of the property is the back side of the house, and is abutting <br />County Road 6. The Code designates any portion of the property abutting a <br />thoroughfare to be considered frontage, thus creating a parcel with tw’o front yard <br />setback areas. Back yard eind side yard setback areas allow for a fence to be constructed <br />to 6 feet. <br />The applicant has stated the location of the property, between the two streets, has lur 'Cci <br />his ability to construct a fence that would provide safety for his children and family pet <br />firom County Road 6. <br />3. The veuiance, if granted, will not alter the essential character of the locality. <br />The variance for increasing the fence height by 6 inches will not have any altering effect <br />on the neighborhood. <br />Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />Undue hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for solar energy systems. <br />Solar access is not a consideration. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />Fences are permitted within encroachm:nt areas in this zoning district. <br />The Board or Council may permit as a variance the temporary use of a one-family <br />dwelling as a two-family dwelling. <br />Not applicable. <br />»2378 William Z Mernik <br />1840 Lakeview Terrace <br />Variance <br />6/15/98 <br />Paged <br />i
