STATEMENT OF HARDSHIP <br />The applicant has designed the proposed residence to accommodate his family and provide space on <br />the main floor for his elderly father. The applicant has indicated that there are 4 drivers in the <br />household and that they desire a 3 car garage. <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions allowed <br />by the official controls. <br />A new residence cannot be constructed without a lot area variance. A residence can be built <br />that meets the hardcover requirements. <br />2. The plight of the landowner is due to circumstances unique to his properly not created by the <br />land owner. <br />The lot is unusual with the north property line next to Loma Linda Avenue. The need for a <br />hardcover variance is created by the house design to provide accessible living .space <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The variance for hardcover and side yard adjacent to the street will change the character of <br />the area by replacing a smaller residence. The current residence is closer to the road. <br />4. <br />5. <br />6. <br />The special conditions applying to the structure of land in question are peculiar to such <br />property or immediately adjoining property. <br />Many of the properties in this neighborhood do not meet the minimum lot area requirements. <br />Some of the existing residence exceed hardcover requirements and have hardcover in the <br />lakeshore setback. <br />The conditions do not apply generally to other land or structures in the district in which said <br />land is located. <br />The side yard adjacent to a .street is not typical for other properties in the area. <br />The granting of the application is necessary for the preser\'ation and enjoyment of a substantial <br />properly right of the applicant. <br />The applicant believes they need to obtain variances to build the residence as designed. <br />#2363 William Bockmann <br />1130 Loma Linda Avenue <br />Date of PC.
